EVENT WAIVER AND RELEASE: MUST AGREE TO REGISTER (cLICK HERE TO READ)
I agree that any and all representations made and releases, waivers, covenants, consents and permissions given by me hereunder are given on behalf of me and any and all of my minor children or persons over whom I have guardianship participating in our attend the Girlfriend Ride held in St. Paul, Indiana on June 26, 2021, including any pre and post event activities (hereinafter referred to as the "Event").
I understand and acknowledge that (i) my consent to these provisions is given in consideration for being permitted to participate in this Event; (ii) I may be removed from the Event if I do not follow all the rules of this Event, which includes following applicable Indiana laws relating to the operation of a bicycle in the State of Indiana; (iii) I am a voluntary participant in the Event who is eighteen years of age, and I hereby warrant that I am in good physical condition and am physically able to participate in the Event, and further acknowledge that I am solely responsible for my personal health, safety and personal property.
I know that the Event is a potentially hazardous activity wherein I may incur injury or death as a result of participating in the Event, and I hereby voluntarily assume full and complete responsibility for, and the risk of, any injury or accident that may occur during my participation in the Event. To the fullest extent of the law, I, for myself, my next of kin, my heirs, executors, administrators, personal representatives, successors and assigns (collectively, "Releasors") hereby release and hold harmless and covenant not to file suit against: (i) Hope Ride, Inc. LLC, and their respective employees, agents, volunteers, members, officers, directors, successors, and assigns; (ii) Any event sponsors; (iii) all other persons or entities associated with the Event (collectively the "Releasees") for any injuries or damages I might suffer in connection with my participation.
This release applies to any and all loss, liability, or claims I or my Releasors may have arising out of my participation including but not limited to personal injury or damage suffered by me or others, whether such losses, liabilities or claims be caused by falls, contact with and/or the actions of other participants, contact with fixed or non-fixed objects, contact with animals, contact with motor vehicles, conditions of the event premises, negligence of the releasees, risks not known to me or not reasonably foreseeable at this time, or otherwise. I recognize and realize that if I chose not to wear a helmet while participating in the Ride that I incur all risks associated with failing to wear a helmet, including but not limited to head injuries, brain injuries, and death. I further acknowledge that the Releasees strongly encourage me to wear a helmet while riding in the Girlfriend Ride, and that if I chose not to wear a helmet it is my decision and I agree that I have incurred the risk of not wearing a helmet. I further agree that knowing the risks of riding a bicycle that I will not drink any alcoholic beverages or use any non-prescription drugs before or during the Girlfriend Ride that might impair my ability to ride a bicycle in any manner. I understand that all minors under the age of eighteen must wear a helmet, and that they cannot participate in the Event unless wearing a helmet at all times.
I hereby certify that I am not relying upon any oral statement(s) or written representations made by any person before signing this Release of Liability, Assumption of Risk, and Agreement Not to Sue, (hereinafter "Release") and I know and understand that by signing this Release that it is intended to be binding to the fullest extent permissible by Indiana law, and that if a Court finds any provision of this document to be invalid or unenforceable the remaining terms and conditions shall be valid and enforceable. I acknowledge that I have read the Release, and I understand that I AM GIVING UP LEGAL RIGHTS WHICH I OTHERWISE MAY HAVE, and that I have agreed to the terms and conditions contained in this Release voluntarily and without any duress or undue influence. I agree with the terms and conditions above.
